These Terms of Service (“Terms”) govern your use of Discord Bot Factory, including the desktop application, Discord Bot Factory accounts, marketplace, sharing features, support features, Gizmo Agent, and other online services provided in connection with Discord Bot Factory.

1. Acceptance of these Terms
These Terms form an agreement between you and the operator of Discord Bot Factory.
You agree to these Terms when you accept them where they are presented to you, including through the Discord Bot Factory application.
If you do not agree to these Terms, you must not use features that require acceptance of them.
Certain parts of Discord Bot Factory are also subject to terms imposed by third parties, including Steam, Discord, Stripe and OpenAI.
Nothing in these Terms removes or limits any consumer right that applicable law does not permit us to remove or limit.
2. About Discord Bot Factory
Discord Bot Factory is software for creating and managing local Discord bots visually, without requiring users to write the bot code manually.
The application includes local bot development functionality and optional online features such as:
- Discord Bot Factory accounts;
- the community marketplace;
- user-to-user sharing;
- Share to Support;
- marketplace voting;
- Gizmo Agent; and
- subscription-based Gizmo features.
The core application and locally generated bot projects do not depend on a Discord Bot Factory account.
Online features are additional services and may depend on third-party infrastructure.
3. Age and legal capacity
There is no specific minimum age imposed by Discord Bot Factory for use of the local, offline functionality of the application.
However, third-party services used with Discord Bot Factory may impose their own minimum-age requirements. You must satisfy the requirements of Steam, Discord, Stripe and any other service you use.
If the law where you live does not allow you to enter into these Terms on your own because of your age, you may use the relevant services only with the permission or involvement of a parent or legal guardian where required by law.
Parents and guardians are responsible for supervising a minor’s use where applicable.
4. Purchase of the Discord Bot Factory application
Discord Bot Factory is distributed through Steam. The standard application is currently sold as a one-time purchase rather than as a recurring subscription.
Your purchase grants you a licence to use Discord Bot Factory. It does not transfer ownership of the Discord Bot Factory software, source code, branding or intellectual property to you.
Subject to these Terms, your Steam entitlement and applicable law, the licence to the purchased application is intended to be perpetual. You may install and use Discord Bot Factory on multiple personal devices where doing so is permitted by Steam, and the devices are being used through the applicable Steam account.
Your Steam entitlement and any transfer, sharing or family-use functionality are also subject to Steam’s rules.
5. Commercial use
Discord Bot Factory is your app, and you may use it to create bots, flows, projects and related material for personal or commercial purposes.
You may, subject to applicable law and third-party rights:
- build bots for yourself;
- build bots for clients;
- charge for bot-development services;
- sell bots or projects you create;
- use your projects in a business; and
- otherwise commercially exploit your own work.
Discord Bot Factory does not claim ownership merely because a bot, project or flow was created using Discord Bot Factory. You are responsible for any business, tax, contractual, regulatory or other obligations arising from your own commercial activity.
6. Software licence restrictions
Except where applicable law expressly gives you a right that cannot lawfully be restricted, you must not:
- copy or redistribute Discord Bot Factory itself without authorisation;
- sell, sublicense, rent or commercially redistribute unauthorised copies of Discord Bot Factory;
- crack or attempt to bypass licensing, access controls, usage restrictions or security mechanisms;
- reverse engineer, disassemble or decompile Discord Bot Factory;
- attempt to obtain, discover, extract or reconstruct Discord Bot Factory source code;
- modify or create unauthorised altered versions of the Discord Bot Factory application;
- tamper with application files for the purpose of bypassing restrictions or protections;
- bypass Gizmo Agent credit or usage limits;
- exploit vulnerabilities or bugs to obtain functionality, services or credits to which you are not entitled; or
- assist another person in doing any of the above.
Nothing in this section prohibits an act that applicable law expressly allows notwithstanding a contractual restriction, including any non-waivable statutory rights concerning software interoperability.
7. Your projects
Except for the Discord Bot Factory software or other material owned by us or by third parties, you retain ownership of the bots, flows, datasets and projects you create.
You are responsible for ensuring that you have the rights necessary to use any material you incorporate into your projects.
Creating something with Discord Bot Factory does not give you rights over somebody else’s copyright, trademark, data, code, artwork or other intellectual property.
8. Marketplace content
8.1 Ownership
You retain ownership of content you publish to the Discord Bot Factory marketplace.
Publishing something to the marketplace does not transfer ownership to Discord Bot Factory. However, because the marketplace is designed for public sharing and reuse, publishing content grants the licences described below.
8.2 Licence granted to Discord Bot Factory
When you publish content to the marketplace, you grant Discord Bot Factory a worldwide, non-exclusive, royalty-free licence to:
- host and store the content;
- reproduce it as needed to operate the marketplace;
- display it to users;
- make it available for download or import;
- distribute it through Discord Bot Factory;
- make technical changes reasonably necessary to store, migrate, format, display or deliver it; and
- feature or reproduce the marketplace post in Discord Bot Factory promotional, marketing, demonstration, social-media or documentation material.
This licence does not transfer ownership of your work to Discord Bot Factory.
The licence continues for as long as the marketplace post remains available through Discord Bot Factory.
If your account is deleted, an existing marketplace post may remain available with the author displayed as “Deleted User”, and the licence necessary to continue hosting and distributing that post continues while it remains published.
8.3 Licence granted to marketplace users
By publishing a flow or other reusable content on the marketplace, you understand that other users are being invited to use it.
You grant users who obtain marketplace content a non-exclusive, royalty-free licence to:
- download or import it;
- run and use it;
- copy it into their own projects;
- modify it;
- combine it with their own work;
- use it for personal purposes;
- use it for commercial purposes; and
- distribute modified or larger projects that incorporate it.
A user may, for example, incorporate a marketplace flow into a bot that they later provide or sell to a client. Copies legitimately obtained while a marketplace post was available are not automatically revoked merely because the original marketplace post is later removed.
Discord Bot Factory does not facilitate or take responsibility for independent sales of raw marketplace content outside Discord Bot Factory. Any such transaction remains the responsibility of the people involved and remains subject to the creator’s rights, the licence granted here, applicable law and any relevant third-party rights.
8.4 Attribution and authorship
Users are encouraged to credit the original creator when publishing a modified version of somebody else’s marketplace work.
Unless a specific licence or rule attached to the content requires attribution, Discord Bot Factory does not currently technically enforce attribution. However, you must not deliberately misrepresent somebody else’s original work as entirely your own or falsely claim authorship in a deceptive manner.
8.5 Your responsibility when uploading
You may publish content that:
- you created;
- you own; or
- you have sufficient permission or licence to publish and make available under these Terms.
By uploading content, you confirm that you have the rights necessary to grant the licences described in this section.
Do not upload material that infringes copyright, trademark, privacy, confidentiality or other rights.
9. Marketplace files and safety
Marketplace posts can include flows, node data, descriptions, tags and optional user-created CSV/database files.
Marketplace content is created by users.
You must review content before using it and should not assume that a marketplace flow, CSV file or other item is safe, accurate, suitable, complete or compatible with your project merely because it is available through Discord Bot Factory.
You are responsible for testing downloaded material before using it in a live bot or production environment.
Verified marketplace content
Discord Bot Factory may manually review certain marketplace posts and display a Verified badge.
A Verified badge means that Discord Bot Factory has manually reviewed the post and considered it appropriate or of sufficient quality at the time of review.
A Verified badge is not a guarantee that the content:
- is free from every bug;
- will work for every user;
- will remain compatible forever;
- is suitable for every purpose;
- cannot cause unexpected behaviour; or
- is legally appropriate for every user’s intended use.
10. Direct sharing
Discord Bot Factory allows users to send flows to another user using a share handle.
The recipient may copy the shared flow and any included data into their own local project.
The sender remains responsible for ensuring that they have the right to share the material.
A direct share is not the same as a public marketplace publication and does not, merely by being shared privately, grant Discord Bot Factory the promotional licence described for marketplace posts.
Once a recipient has imported or copied shared content onto their own device, Discord Bot Factory cannot automatically remove that local copy.
12. Acceptable use
You must use Discord Bot Factory lawfully and responsibly.
You must not use Discord Bot Factory, the marketplace, sharing features or Gizmo Agent to:
- violate applicable law;
- violate Discord’s applicable Terms, Developer Terms, Developer Policy, Community Guidelines or platform restrictions;
- conduct raids, harassment or abusive automation;
- create or distribute malware, destructive code or malicious payloads;
- engage in phishing;
- steal passwords, authentication tokens, credentials or account access;
- facilitate unauthorized access to systems or accounts;
- scrape, collect or process personal information without the necessary permission or lawful basis;
- bypass Discord rate limits or platform protections;
- bypass Discord Bot Factory usage, security or licensing restrictions;
- circumvent Gizmo Agent credit or usage limits;
- manipulate marketplace votes;
- operate multiple accounts to abuse free services, voting or limits;
- upload malicious flows, CSV files or other content;
- infringe copyright, trademarks or other rights;
- impersonate another person or falsely claim affiliation or authorship;
- distribute child sexual abuse material;
- facilitate terrorism or other serious criminal activity;
- facilitate fraud or scams;
- publish unlawful threats or seriously abusive content; or
- use the service to facilitate other unlawful conduct.
Content intended to expose users to pornography or to encourage suicide, serious self-harm, eating disorders or other unlawful/harmful material is also strictly prohibited.
13. Reporting content and safety concerns
Illegal, infringing, malicious or otherwise prohibited marketplace content can be reported through Discord Bot Factory support, including:
Users may also contact Discord Bot Factory through the official Discord support channels.
Direct user-to-user shares may additionally provide an in-app reporting feature.
When we become aware of content that appears to be illegal, malicious or contrary to these Terms, we may investigate and may remove or restrict it.
Serious safety issues may be acted on immediately without prior notice.
We may retain information relating to a reported item for as long as reasonably necessary to investigate the report, comply with legal obligations or protect users.
14. Moderation decisions and appeals
Discord Bot Factory may:
- remove marketplace content;
- restrict access to content;
- remove malicious shared content;
- suspend online features;
- suspend accounts; or
- permanently terminate Discord Bot Factory accounts.
We may take immediate action where reasonably necessary because of serious abuse, security concerns, malicious activity, illegal content or significant risk to users.
Where appropriate, users may appeal a moderation or enforcement decision by contacting us through Discord support or at:
We will consider appeals in good faith but do not guarantee that a decision will be reversed.
Where the UK Online Safety Act 2023 applies, if Discord Bot Factory removes or restricts regulated user-generated content that you generated, uploaded or shared, or suspends or bans you, in breach of these Terms, you may have a right to bring a claim for breach of contract. Nothing in these Terms excludes such a right where the law provides it.
15. Intellectual-property complaints
If you believe marketplace content infringes your copyright, trademark or other intellectual-property rights, contact:
Please provide enough information for us to identify the affected material and understand the basis of the complaint.
We may temporarily restrict or remove disputed content while investigating.
The uploader may be given an opportunity to respond or appeal where appropriate.
Repeated or serious infringement may result in suspension or permanent termination of an account.
Submitting a false or abusive infringement complaint may itself violate these Terms.
16. Discord Bot Factory accounts
An account is not required to use the core local functionality of Discord Bot Factory. Optional online functionality may require a Discord Bot Factory account. New accounts currently use Discord OAuth authentication.
You are responsible for maintaining control of the Discord account used to authenticate your Discord Bot Factory account.
You must not circumvent account restrictions or create additional accounts for the purpose of avoiding an enforcement action, manipulating votes or exploiting free usage.
Discord Bot Factory accounts and the optional services attached to them do not constitute property that can be sold or traded independently of the applicable authentication system.
17. Gizmo Agent
Gizmo Agent is an AI-assisted feature.
Gizmo Agent may use information that you provide together with relevant project context in order to generate a response. Gizmo Agent relies in part on third-party AI infrastructure provided by OpenAI.
AI limitations
Artificial intelligence can make mistakes.
Gizmo Agent outputs may be:
- inaccurate;
- incomplete;
- outdated;
- misleading;
- unsuitable;
- technically incorrect;
- insecure;
- buggy; or
- incompatible with your intended project.
You are responsible for reviewing and testing Gizmo Agent output before relying on it. Gizmo Agent is an assistance tool and does not replace your own judgment.
Do not use Gizmo Agent for illegal, malicious, abusive or harmful purposes.
18. Gizmo plans and subscriptions
Gizmo Agent currently includes a free tier and optional paid plans.
As of the effective date of these Terms, the standard advertised paid tiers are:
Gizmo Agent Plus - $4.95 USD per month
Gizmo Agent Pro - $9.95 USD per month
The actual price and billing terms shown to you before checkout control your purchase.
Payments are processed by Stripe. Discord Bot Factory does not directly receive your payment card details.
Recurring billing
Where a paid plan is identified at checkout as a recurring subscription, it renews according to the billing arrangement shown through Stripe until cancelled.
You are responsible for reviewing the billing information shown before subscribing.
Credits and limits
Gizmo credits renew according to the applicable monthly plan cycle. Unused monthly credits do not roll over into future billing cycles. Any applicable daily limits reset automatically according to the service’s configured limits.
Plan limits, models and features may change in future. Where reasonably practicable, we will provide notice of material changes.
Cancellation
You may cancel a recurring Gizmo subscription using the applicable subscription or billing controls.
Unless otherwise required by law or stated at cancellation, cancellation normally prevents the next renewal and you retain paid access until the end of the current billing period.
Refunds
We do not ordinarily provide prorated refunds merely because a user voluntarily cancels partway through a billing period.
This does not affect statutory refund, cancellation, repair, repeat-performance, price-reduction or other consumer rights that apply to you.
Consumers may have statutory cooling-off rights for contracts entered into online. For example, UK consumers ordinarily have cancellation rights for qualifying distance service contracts during the statutory cancellation period.
Where you request that a paid service begin immediately, the consequences of cancelling during a statutory cooling-off period - including whether payment may be due for service already provided - are determined by applicable law.
Nothing in these Terms is intended to remove such rights.
Failed payments
If Stripe or our billing systems report that your subscription is no longer active or paid, Discord Bot Factory may suspend paid Gizmo features or revert the account to an applicable free tier.
Price changes
We may change Gizmo subscription prices in future.
Where required by law, and otherwise where reasonably practicable, affected subscribers will receive notice before a changed recurring price applies.
If you do not wish to continue at a new price, you may cancel before the relevant renewal.
19. Steam refunds
Purchases of the main Discord Bot Factory application through Steam are handled through Steam’s purchasing and refund systems. Discord Bot Factory does not separately process ordinary Steam purchase refunds.
Your eligibility for a Steam refund is determined through Steam’s applicable refund process together with any mandatory consumer rights that apply to you.
Nothing in these Terms reduces any statutory rights that you may have in relation to faulty or non-conforming digital content.
20. Bots created using Discord Bot Factory
Bots generated using Discord Bot Factory run on infrastructure chosen by the user.
This may include:
- the user’s own computer;
- the user’s server;
- a VPS;
- a third-party hosting provider; or
- other infrastructure selected by the user.
Discord Bot Factory does not operate your generated bot on your behalf merely because it was created using Discord Bot Factory.
You are responsible for:
- what your bot does;
- where it is hosted;
- how it is configured;
- what Discord permissions it has;
- what data it receives;
- compliance with Discord’s applicable rules;
- compliance with applicable privacy and data-protection law;
- compliance with rate limits;
- securing your hosting environment; and
- testing your bot before production use.
If your bot collects or processes information about other people, you may have your own legal obligations relating to that processing.
21. Bot tokens and credentials
Discord Bot Factory is designed to handle bot credentials using its intended security practices, including local environment files where applicable.
Do not intentionally share bot tokens, API keys or other secrets.
If you export, upload or disclose your project files or environment files to a third-party hosting provider, repository, person or service, you are responsible for considering whether doing so exposes your credentials.
Discord Bot Factory is not responsible for credentials that are compromised because you disclose them, publish them or handle them outside the safeguards and practices provided by Discord Bot Factory.
22. Third-party services
Discord Bot Factory interacts with or depends on third-party services including Steam/Valve, Discord, Google/Firebase, Stripe and OpenAI.
Discord Bot Factory is an independent product.
Discord Bot Factory is not sponsored, endorsed by, affiliated with or an official product of Discord Inc., Valve Corporation, OpenAI, Stripe, Google, or their respective affiliates, unless expressly stated otherwise.
All third-party trademarks and names remain the property of their respective owners.
Your use of third-party services is subject to their own terms, policies and technical restrictions.
We are not responsible for a third party:
- changing its API;
- changing its policies;
- changing pricing;
- restricting an account;
- banning a bot;
- removing an application;
- suffering an outage;
- changing rate limits;
- discontinuing a service; or
- otherwise making a change outside our reasonable control.
We will make reasonable efforts to adapt Discord Bot Factory to material changes affecting supported functionality where doing so is reasonably practicable, but we cannot guarantee continued compatibility with every third-party platform.
23. Project storage and backups
Discord Bot Factory projects are primarily stored locally.
You are responsible for maintaining appropriate backups of projects that are important to you.
Discord Bot Factory may create additional local backup or recovery copies to reduce the risk of corruption or accidental data loss, but these safeguards are not foolproof and are not a guaranteed backup service.
We do not promise cloud backup or cloud recovery of your local projects.
We are not responsible, to the extent permitted by law, for data loss caused by matters outside our reasonable control, including:
- device failure;
- drive failure;
- user error;
- accidental deletion;
- third-party backup software;
- cloud-sync providers;
- hosting providers; or
- unauthorised modification of application/project files.
If a Discord Bot Factory defect causes project corruption, we may attempt to assist with recovery or provide a fix where reasonably possible, but successful recovery cannot be guaranteed.
24. Updates and compatibility
Discord Bot Factory may receive updates, bug fixes, security changes, compatibility changes and new features.
Features may be added, modified or removed over time.
We aim to preserve compatibility with older Discord Bot Factory projects to the best of our ability and where reasonably practicable.
However, we do not guarantee that every historical project, integration or third-party feature will remain fully compatible with every future version forever.
25. Online service availability
Online services such as accounts, marketplace functionality, sharing and Gizmo Agent may occasionally be unavailable because of maintenance, security incidents, provider outages, technical problems or other events.
We do not guarantee uninterrupted availability, a particular response time or 100% uptime.
We may temporarily restrict a service where reasonably necessary to:
- perform maintenance;
- improve the service;
- respond to an outage;
- protect security;
- investigate abuse; or
- comply with legal obligations.
Where reasonably practicable, we will try to minimise disruption.
26. Future discontinuation
We intend to maintain Discord Bot Factory and its services for as long as reasonably practicable, but we do not promise to operate every feature indefinitely.
Optional online services may eventually be modified or discontinued.
Where reasonably practicable, we will try to:
- provide advance notice of significant shutdowns;
- reduce unnecessary disruption; and
- make reasonable arrangements so that the local application’s core functionality is affected as little as reasonably possible.
This is an intention rather than a guarantee of a particular notice period.
27. Suspension and termination
Termination by you
You may stop using Discord Bot Factory at any time.
You may delete your Discord Bot Factory account using the available account-deletion functionality.
Account deletion is separate from your Steam installation or entitlement.
You may separately cancel a Gizmo subscription using the applicable billing controls.
Deleting an account does not automatically revoke licences already granted for marketplace material that remains published or copies already legitimately obtained by another user.
Termination or suspension by us
We may restrict, suspend or terminate an account or online service where reasonably necessary because of:
- a material or repeated breach of these Terms;
- illegal activity;
- malicious activity;
- fraud or attempted fraud;
- security threats;
- abuse of Gizmo or free credits;
- vote manipulation;
- infringement of intellectual property;
- serious Discord-policy violations connected to use of the service;
- threats to other users or the service; or
- other serious misuse.
Serious violations may result in immediate action.
If an account is terminated for serious abuse, associated paid Gizmo access may also end.
A user terminated for breach is not entitled to a discretionary refund merely because of the termination. This does not remove any refund or remedy that applicable law requires us to provide.
Suspension of a Discord Bot Factory online account does not by itself necessarily terminate your Steam entitlement to the core application.
However, serious breaches directly involving the software licence – such as piracy, cracking, unauthorised redistribution or deliberate circumvention of licence protections – may result in termination of rights granted under these Terms to the extent permitted by law.
28. Discord Bot Factory intellectual property
Discord Bot Factory and its original software, source code, application design, user interface, documentation, branding, graphics, logos and other original assets are protected by intellectual-property law.
Except for the licence expressly granted to you, all rights in Discord Bot Factory remain reserved.
You may not use Discord Bot Factory branding in a manner that falsely suggests another service, software product, bot or business is operated, approved, sponsored or endorsed by Discord Bot Factory.
Third-party software, libraries or assets included in Discord Bot Factory remain subject to their respective licences where applicable.
29. Privacy
Our collection and use of personal information is described separately in the Discord Bot Factory Privacy Policy.
These Terms and the Privacy Policy serve different purposes.
Agreeing to contractual Terms does not replace any consent or other lawful basis required under applicable data-protection law.
30. Consumer rights and warranties
If you are a consumer, applicable law may give you mandatory rights concerning digital content and services.
For example, UK consumer law can require paid digital content to be of satisfactory quality, fit for an applicable particular purpose and as described, and can provide remedies where those requirements are not met.
Nothing in these Terms excludes or restricts a right or remedy where the law does not permit us to do so.
Subject to those rights, we do not promise that Discord Bot Factory will:
- be completely free of bugs;
- operate without interruption;
- be compatible with every computer or third-party service;
- support every possible bot design;
- prevent every user error;
- remain unchanged forever; or
- guarantee that third-party services remain available.
31. Liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence where such liability cannot legally be limited;
- fraud or fraudulent misrepresentation; or
- any other liability that applicable law does not permit to be excluded or limited.
Consumers
If you use Discord Bot Factory as a consumer, we do not exclude liability for loss that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where applicable law makes us responsible.
We are not responsible for loss that was not reasonably foreseeable.
If you use Discord Bot Factory primarily for personal purposes, we are not responsible for business losses such as lost profit, lost revenue, lost contracts or lost business opportunities resulting from that personal use, except where applicable law provides otherwise.
Nothing in this section limits your mandatory consumer rights.
Business and commercial users
If you use Discord Bot Factory wholly or mainly for a trade, business, craft or profession, then, to the maximum extent permitted and considered reasonable under applicable law:
Discord Bot Factory is not liable for indirect or consequential loss, loss of profits, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill or loss of business opportunity.
Our total aggregate liability arising out of or relating to Discord Bot Factory will not exceed the amounts you paid for the software and services giving rise to the claim during the 12 months preceding the event giving rise to the claim, or, where no payment was made during that period for the base application, the original purchase price you paid for the base application.
Matters outside our responsibility
To the extent permitted by law, we are not responsible for losses caused by:
- a bot that you created or configured;
- a Discord ban or restriction;
- deletion or restriction of your Discord application by Discord;
- changes to Discord’s API;
- third-party hosting;
- third-party outages;
- marketplace content supplied by another user;
- a user-created CSV or database;
- an inaccurate or unsuitable Gizmo Agent response;
- credentials you exposed contrary to our safeguards or instructions;
- your failure to test a bot or marketplace flow before deployment;
- unauthorised modifications to Discord Bot Factory;
- your failure to maintain reasonable backups; or
- transactions or agreements you enter into independently with another user or third party.
32. Third-party claims and your conduct
You are responsible for your own content, bots, commercial activity and use of third-party intellectual property.
Discord Bot Factory does not endorse user content merely because it is hosted on the marketplace.
If you use Discord Bot Factory in the course of a business, then, to the extent permitted by law, you will indemnify Discord Bot Factory against reasonable losses, liabilities and costs arising from a third-party claim caused by:
- content you knowingly uploaded without necessary rights;
- your bot’s unlawful operation;
- your infringement of another person’s intellectual-property rights;
- your deliberate illegal activity; or
- your material breach of these Terms,
except to the extent the claim was caused by Discord Bot Factory’s own breach, negligence or unlawful conduct.
For consumer users, this section does not impose liability beyond what is fair and enforceable under applicable consumer law.
33. Changes to these Terms
We may update these Terms where reasonably necessary because of:
- changes to Discord Bot Factory;
- new features;
- changes to subscriptions;
- security requirements;
- legal or regulatory changes;
- third-party platform changes; or
- operational requirements.
Where a change is material, we will provide notice where reasonably practicable and where required by law.
Updated Terms apply prospectively from their stated effective date.
They do not retrospectively remove rights or remedies that have already accrued.
Where legally permitted, continued use of an account or online feature after updated Terms take effect may constitute acceptance where the updated Terms and consequences have been properly communicated.
Where affirmative acceptance is required, we may ask you to accept the updated Terms before continuing to use affected services.
If you do not agree to materially revised terms applicable to an optional online service, you may stop using that service and cancel an applicable subscription.
34. Governing law and disputes
These Terms are governed by the laws of England and Wales.
Before beginning formal legal proceedings, you and Discord Bot Factory are encouraged to contact the other party and make a reasonable attempt to resolve the dispute informally.

If you are a consumer, nothing in this section deprives you of mandatory protections provided by the law of your country of residence or any right you have under applicable law to bring proceedings in a court that has jurisdiction over a consumer dispute.
If you are using Discord Bot Factory in the course of a business, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms, except where applicable law requires otherwise.
35. Severability
If part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as modified to the minimum extent necessary or, where modification is not possible, removed.
The remainder of the Terms will continue to apply.
36. No waiver
If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it.
37. Entire agreement
These Terms, together with any additional terms expressly presented for a specific Discord Bot Factory service and any mandatory third-party platform terms that apply, form the agreement governing your use of the relevant Discord Bot Factory services.
Nothing in this section excludes liability for fraudulent statements or affects mandatory consumer rights.
